I hate to laugh at the misfortune of others but I have to… this is kind of funny. It shows how hard up some mortgage guys are right now. I live in a gated Tampa community, which is not considered rich… but affluent. The gate clearly displays a no trespass/no solicitation sign. So I come home this afternoon and notice going through the neighborhood that many mailboxes have been flyered. I turn the corner onto my street and see a couple of guys being run off a property by my neighbor… a retired FBI guy. I go over to ask him what’s up & he hands me a flyer advertising 100% cash out, EZ qualifying.

Before I can finish reading the flyer a few of Tampa’s finest swarm in to put cuffs on these guys and drive them off. The third cop whom my neighbor knows comes down to talk with us. He explains to us that believe it or not, these two guys are being charged with trespassing, unlicensed solicitation and here’s the kicker… a possible felony for door-to-door solicitation of a high cost mortgage product. (If it sticks). They are also in violation of federal law for placing flyers on the mailboxes. I actually feel bad for these guys… maybe I’ll offer them telemarketing jobs when they get paroled… LOL

honestly why is everyone all up in arms about flyers? not even that it was mortgage guys and im biased being in the business but lets put this in presepective

1) a retiree had nothing better to do that day but bust the balls of a couple guys trying to make a living when instead of yelling at those guy for 10 minutes he could of spent 10 seconds of his pathetic life and thowing the flyer away if he didnt want it

2) police paid by taxpayer money spent time away looking for rapists, murderes, child molestors etc, and arrested people out working, not sitting at home on welfare but trying to earn thats right EARN dollar



have we really come to this point in our country where we are offended that much by a flyer on our mailbox, its not that hard to lift the lid on a trashcan

yes but here in Tampa with this Green guy among others mortgage infractions are a big issue as I am sure they are everywhere else

araiderfan, it's also not that hard to read and obey signs saying "no solicitation"
Do you park in handicap spots because you're in a hurry or all the close spots are taken? Read the signs, obey them. If they flyer where they aren't suppose to, they probably do follow other rules.

No it was the fact that they had no regard for the no trespass/no solicitation sign and they were door knocking as well. There is a reason that we pay the ridiculous taxes & CDD fee's that we do. We also get a little better police service due to the various sports figures in our area... and I almost forgot... it is a federal violation to put anything in or on a mailbox that was not delivered by the post office.

wow are you serious? so Im assuming you dont speed, you fully stop at all stop signs and (not just a rolling stop) and follow all other laws (such as not spitting because believe it or not it is technically illegal to spit outdoors) no matter how stupid? and really by your logic you would have our police out arresting jaywalkers, solicitors, and spammers everywhere instead of doing their job arressting real felons? Im just as annoyed as anyone when I get junk mail or flyers, or get an annoying solicitor at my door, but its a sad sad pathetic day when the police are involved

RIGHT THERE IT IS!!! nothing against you personally but why the hell should sports figures get better police service, thats biased and technically illegal as well, that anyone should get preferential treatment becuase of who they are, yet you expected them to follow the law when even the police in your area dont

too badit was the minimum wage flyer hander outers that got arrested, and not the people who organized the campaign.

how do you deal living in a gated community? my weekly blow out all nighters would get my neighbors steamed and id get booted.

yet when someone doesnt want to work hard for his business we tend to crucify him, these guys were hitting the streets to do it! how many others are willing to do that? like I said if you dont like it throw away the flyer, its not poisonus, or barbed, at worst you may get a paper cut from it, but put a band aid on it and quit crying

the obeying the law things were actually directed at cscm when he asked if I park in handicapped spots i was pointing out how flawed his logic is

and as to your logic its flawed as well in the fact that even though you CAN buy better police service it doesnt make it right, my taxes ar probably as much as a lot of people house payments, but do I demand better police service becuase I make more money? come on, your basic rights in this country are to be treated equally and your simply pointing out what everyone knows, that that is not the case, but thats another issue for another day


the issue at hand is people are being thrown in jail for trying to earn an honest living, thats far from right

it's also illegal to put anything in a mailbox unless it it's actually real mail. It's also really, really tacky to plaster flyers when you're specifically told not to do it. It's the equivalent of "spam"

Thats it right there... Girl Scouts, Boy Scouts and that type of non-profit is exempt... your're not even comparing to similiar situations. Door to door for profit sales is also legal, if you have a Tampa permit and do not trespass... placing anything on or in a mailbox is a federal violation

I'm guessing from your response that its okay to break the law if you disagree with it.

1. They should outlaw all marketing of mortgages in the United States. It's high time Congress got involved in this important issue and put a stop to all these "mortgage brokers" who have been making money at the expense of the poor meek homeowners in this country who got their homes by slaving away at day labor jobs only to see their life savings sucked out by the evil that is the mortgage business.


2. If a homeowner wants to talk about their mortgage they should be forced to sit in line and fill out lots of long forms at a bank, and then if they qualify they can schedule a time to come in and see a bank officer who can decide if they should be able to buy a home/and or refinance if they have at least....50% equity in the home. We need to see that tese homeowners are committed to actually living in these homes...minimum of 5 years in the home before they can refinance.

3. What to do with all these whining mortgage brokers...it's off to a federal penetentiary for the majority of them, and when they are released they can get a job as a gardener for the homeowners that they forced into all those refinances all those years. Nevermind the fact the homeonwers spent all their equity at Nordstroms, Crate and Barrell, the Pottery Barn...it's high time these mortgage borkers learn the meaning of a dollar and force them into manual labor. The Salespeople that work at all these retail stores can join the mortgage brokers too and hold the bags that they fill up with leaves and grass.

On One hand I feel bad that they were busted for doing a "job"

Here in Ca (Los angeles) we have folks bombard you everytime you drive into a Home Depot.... Or the lines in check cashing places are out the door.....

If they are working them let them work

BUT....

On the other hand if it said no trespass/no solicitation Then they should OBEy those signs... When I am out marketing if they have a sign posted then I dont leave anything.... BUt I do send out a post card stating that I was in the neighborhood and just wanted to say HI.... If they call me than I can go forward if not it cost me 38cents...

dont take the high road if you yourself are going to pick and choose laws

its a flyer not a bomb, really think about what happend there, a man could potentially go to jail for as long as a rapist if he is comvicted of the felony? is that really neccessary?

and honestly they probably didnt get any business out of it, I know I have never personally had any luck with direct marketing, but ive never been arrested for it either

you are 100% correct! but then why shouldnt these guys have been cut a break? if police can pick and choose the laws to follow (IE income discrimination) then why cant they choose to help out a poor schmuck trying to carve out a living

the law is not black and white, and you saying it is earlier means you are a hypocrit. there are grey areas such as tampas "finest" could have said " you are tresspassing leave and dont come back" but no choose to clog our already overcrowded jails with this new "criminals"

if youre willing to pay out your own actual cash for better police protection, or some sort of private sercurity firm, or if you wanna pay sick RE taxes to get better police, then go for it. there is nothing wrong with that.

As I said before... I had nothing to do with it... You're trying to shoot the messenger. I don't determine who is arrested anymore than the cops determine who gets a mortgage.

The no trespassing business aside, I think a little common sense could have been used here by all parties involved. Assuming that this was a first time thing, having the cops run them off the property would have been enough. Arresting them and trying to charge them with a felony is just overkill. Now if they keep coming back after being warned, then well they've made their bed, so let them lay in it.

I mean if you get right down to it, trespassing or not, I would rather see guys out trying to earn a living instead of sitting on their butts living on welfare.

Oh I have so tried to stay out of this thread but I just can't help myself.

If I buy a home in a gated community (which I am planning to do, btw), I'm already paying xtra for that feature, *and* I get to pay association dues every month for the privilege of being in a gated community and salespeople show up, yeah I am gonna be majorly ticked off.

I mean wtf am i paying all this xtra $ for except not to be bugged by salespeople in the privacy of my own home.

Send me all the direct mailers you wish.

But do not stick flyers in my mailbox or on my windshield.

As someone who spends a fortune for 1st class postage every yr for farming, I am also ticked off at those sleazes who think they can get away w/sticking their ads in postal boxes for free. There actually are penalties for that.

I don't know that prison time is in order but then I also don't know the history of these guys, perhaps there were other issues we don't know about? Other complaints? Old warrants? Who knows.

But heck yeah, I'd be angry too.

Ok, from the direction of the responses it sounded like most are men, let me give you a woman's prospective of the flyer issue. I live in a gated community with no solicitation. I live there for one reason, SECURITY. Whose to say these guys weren't going door to door with flyers to see if a young girl or woman was home alone that they could victimize?? Or an elderly couple they could take advantage of. I pay for that security. I didn't "come" from money, I worked my behind off to be able to afford it. If the guys were legit and hard working, well they should have read the signs at the gate.
