The two year requirement can be waived, if you can demonstrate it as due to extraordinary circumstances. Divorce does not count. Make sure you can clear CAIVRS, too. The only time I have been able to get a VA through prior to the 2 year mark was due to a family with a genetic disorder and they lost two children within a period of 14 months. We documented the file with the medical bills, newspaper stories in The Washington Post, copies of fund raising flyers and announcements, and statements from the doctors. They reaffirmed their home and auto and any credit cards that did not have medical charges on them.
I had another case where a Veteran was stationed in Germany and his wife in the US had his POA. She bought her new boyfriend a car and co-signed a condo for him, not to mention, racked up his credit cards. He came home to new debt and filed for divorce. The appraisal came in low and we had put the poor guy through the ringer. He wanted no part of trying again. I would have put the petition for divorce (listing the reasons), as well as, the documented proof in his file, along with his orders, showing he was not in the States. I was later told it would have been denied, because stupid is not an extraordinary circumstance. |
