As of July 1st all non attorney processing companies not registered with the department of justice are subject to fine, cease and desist or worse. If you are a individual, company or corporation selling loan mods you need to work with a Law Firm to handle your files. How would we legally solicit leads to give your attorney based processing company , are we collecting the payment or would the company sending the file collect the payment ?

You will have to have the fee paid in the attorneys name.

are you talking about processing companies or loan modification companies?
Do you have the ruling from the Dept. of Justice under what department? Is it cover all the states of USA?
How you handle the state that does not allow upfront fee?
Is the retainer agreement between your office and my potential client?

This is California only, AB 180 effective July 1, 2009.

And by the way, I don't think you are correct OP.

What would you call the compensation that is paid to the person or company that brings you a client? The state bar will have issue with that. There is no way to do it on a case by case compensation basis.
