I was reading some post on RESPA and paying per closed loan, a violation. I have a similar senerio I was wondering if someone would weigh in on.

Its swaping leads with mortgage people. I need leads of people that have been turned down for financing... I have in my possesion leads of people who are tring to obtain financing and can(or very likely can) acheive financing. Can we trade? or Can we trade if both of the "leads" agree?

Thanks for any thoughts...

I see no reason why leads can't be traded as
long as the quantity offered doesn't depend on
the number of loans closed. A lead is a "thing
of value" so the exchange can't be tied to performance.

Xactly, keep performance out of it and you're fine...BUT, posting the same RESPA question 3 times IS a violation, be careful, you're at 2! LOL j/k
