I was recently emailed to see if I would be interested in some ARM leads from a BO vendor...I played along and asked a few questions, one being what makes you different from Adjustable Rate Marketing(hehe) seeing if he would make the connection...He didn't...

I kept playing along as he implied that his company would be responsible for the $11,000 fine I would get if I called someone he said was scrubbed but was on DNC:

I asked if I had to scrub them myself:
No, Not at all. We scrub them for you.

Then I asked:

So, let's say in case there is an error, who pays the fine if do call someone on the DNC, by accident of course?

Well in our 10 years that we have been in business we have never run across that problem. Though if you do we would have to pay the penalty seeing as the confirmation that you receive after the order is taken says we scrub them against the DNCL. I asked him to send me that in writing which of course he couldn't/wouldn't...

I then told him who I was, that that was total BS and that he was setting brokers up to get nailed, he didn't care...

Long story short, I know, too late, NOBODY CAN RELIEVE YOU OF YOUR RESPONSIBILITY OR LIABILITY in regard to the DNC, don't let anyone tell you different...I don't need to give the name out, just CYA, the info below will keep you out of trouble...

Go to dncscrubbing.com talk to Chris Harshbarger about his very cheap monthly program to make sure you are compliant, he CAN and WILL guarantee it!

This reminds me of the guy that called me about call broadcasting going out in my name for Chapter 13 debtors. Even though I knew that I would not be using his services, I asked what the voice message to these chapter 13 debtors said. It was something to the effect of "I am required to contact you about your Chapter 13 case by the FHA..."
A lot of these people selling their "services" do not care about any compliance issues nor what can happen to those who use their "services". (Stephen excluded.)

Reminds me of a letter that a borrower showed me after we closed his FHA loan.

The letter basically said that there was an error on his loan and that he is required to sign new paperwork with them to correct the error.

Good post Stephen.

We've seen more people contacting us lately that are under the impression that as long as the data is scrubbed by any party it's compliant... as your post notes...it's not. The "seller" IE, the loan officer is responsible for ensuring DNC compliance, scrubbing their data with their own SAN number and the Seller is liable should there be a fine.

Anyone who tells you otherwise is a liar and you should run not walk away from doing business with them. Do you really want to do business with someone that lies to you and could careless if you incur fines that could put you out of business?

Keep 'em coming Stephen. Don't get too busy that you forget to hang with us little people on the BO.
