I'd like to get some fellow outpost members opinions on this...

So I have a file, its my friends loan and he has relocated to another state.

My friend finds a house with a Realtor and signs a contract. I work up the Good Faith and the realtor calls me about the closing cost and asks if the Lender can give a credit?
Its my friends loan, so I am already not making a killing on the loan and I reply with NO, I cannot. I then asked the agent if he wanted to give the buyer 1% of his commission to help with closing cost asto he was making 4%. The agent said absolutely not, its not negotiable and that is standard buyers commission.(Antitrust?) I told him I am realtor in another state and we give credits all the time. I also said I did not be to offend him in anyway.. He was pissed and ranted.

He then tried to pull my friend to another broker.

So we got off on a bad foot.

I have recieved an approval on his loan. I am working with the closing attorney and getting the gift grant paperwork to them. The contract had been adjusted from 173,000 and seller paying 4950 in closing cost to 171,000 and seller paying 2950 in closing cost.

So the Closing Agent wanted to double check, So she called both agents about the contract. I also forwarded over to her the contract that I had received

I get a call from the buyer's agent, and he stays to me that he hopes this is not a Bait and Switch Tacket and goes on about how I need to call him on a voicemail. I did not get the message until later in the evening so I did not call him back.

Then the next morning, he sends out an email to me and then cc's my cilents, the closing attorney, and the sellers agent about how he hopes this is not a bait and switch caper and that I have always been in the know. Then no later than 5 minutes, my friend the cilent calls me and is worried if something is wrong with the deal!!??
I explained what was going on.. he said it seems like the agent has a personal problem with you.

Then sellers agent sends an email about how this was mix up with her contract and how the closing attorney had gotten the wrong contract.

Now I feel that if this buyer/cilent was not a personal friend.. that he would have walked away from me and went somewhere else because of the realtor/agent. I also feel that he defamed my character, to my cilents, to the agent, and closing attorney and insuitated that I was doing something to harm/illegal to the buyer.

I have researched this and placed a call to their broker for their legals contact information and their E&O contact information.

Has anyone dealt with anything like this before?

Defamation of Character?

Whats your take???

i would have told your friend to fire that realtor.

I agree with Banker, but your best bet is to close the loan, help your friend and be thankful that you will never have to work with this realtor again.

Go out and do something more productive, an ass, is an ass, is an ass it's just that simple and not worth wasting any of your valuable time.

The challenge with defamation of character is proving damages. If you are working in that market and now you lose a bunch of business, maybe, but since you don't do much work there and since the only ones that know about the situation are the agents, closing agents and your friend I wouldn't worry too much about it.

Yeah..its a waste of time to pursue...

Spend more time working it to end up empty handed,

when I could be working to get more business.


Funny for him, this is probably his only deal. haha...

I keep 6 sheets that are taped together.....I run them through as a loop, but you have to do it at like 3am so that all of the toner in the fax machine gets killed by morning.

my friend did that...and the realtor asked him what was his problem??
he said he was faxing over the appraisal, and it 'kept on cutting him off' lol

he tried to send the 15pages like 5-6times lol

funny thing was that the appraisal didnt get done until a few days later lol
he had to call her to schedule it with her, and she never remembered!

the sad thing about this is that even though many of us on here despise realtors, for some reason they almost always have our client's ear more than we do (even if the client is a friend).

Realtors appear to be super knowledgeable and credible to our clients even though they are usually morons..

why is that and how can it be changed??

One great way of reminding the clients and the agents is showing them that we are the glue that holds their deal together and that we dont just close 3-5 deals a year but up to 10+ a month. Let the level of business and number of deals speak for your experience.

If you actually ARE an expert and are knowledgeable then there is no problem if you act confidently and calmly with your clients. A large number of brokers (not the ones on BO!) are in fact total morons who jumped in the biz at some point and make everyone look bad.
