 Search for: Forcing someone off of a deed?.

Ugh...this is probably the best "think before you act" scenario I can possibly handle:

Boyfriend and girlfriend buy a house together. They break up, she moves out and has been for a while.

Boyfriend wants to refi out of an ARM and there is a sense of urgency to get it done.

Girlfriend wont sign quit claim to get off deed, merely wants to be on the loan for sole purpose of establishing credit, nothing else.

He qualifies fine on his own and doesnt need her on there anyways.

Worse....she is refusing to send me any of her required documentation (paystubs, W2s) and is holding up the entire process. Tried calling her, phones disconnected.

Is there any way around this or am I stuck until she pulls her head out of her ass?

Can you buy a fake death certificate from somone on the internet?

You are stuck, you may be able to offer her some money to get off. Explain to her that the existing loan will show up good on her credit and now she can go off and buy her own or whatever. Explain to her also that since it is an ARM that they currently have, the payment could go up and that may cause boyfriend not to be able to pay, thus ruining her credit. Since she no longer has anything to do with the home, it is much better for her to be off of the loan than on it. What happens if he gets into a car accident and she gets sued as well because they are both on title, what about if he wants to screw her over and decides not to pay the note. For liability purposes it makes no sense for her to be on the note and see if she will budge. You may have to go to court to get her off is she doesn't want to budge.

He is stuck. The only way to get her off title is for her to deed, to get a court order or file a quiet title action.
He bought the cow instead of getting the milk for free.
This is probably a control thing for her. Chances are that you already know what she is, and now it's only a question of price.
